Murton Event Solutions — Terms and Conditions
Business customers and temporary worker supply
Effective date: 01/01/2026
1. About us and these terms
1.1 These terms govern the use of our website and the booking and provision of temporary workers and associated services by Murton Event Solutions (“we”, “us” and “our”).
1.2 Our details are:
Legal business name: Murton Event Solutions LTD
Registered or business address: 3 Rushton Yard, Market Street, Ashby-De-La-Zouch, Leicester, LE651AL
Company registration number: 14571477
Email: info@themurtongroup.com
Telephone: 01530440283
1.3 “Client”, “you” and “your” mean the business purchasing our services. “Worker” means a person supplied by us to undertake an assignment. “Assignment” means the agreed work undertaken for the Client. “Booking Confirmation” means our written confirmation of the assignment and its commercial terms.
1.4 These terms apply to clients acting in the course of their trade, business, craft or profession. If you are booking mainly for private or personal purposes, you must tell us before booking so that appropriate terms can be provided. Nothing in these terms removes any statutory consumer rights where they apply.
1.5 “In writing” includes email.
2. Our services
2.1 We supply temporary workers to businesses in the United Kingdom and Europe for assignments agreed in writing.
2.2 The Booking Confirmation will identify the services, roles, location, dates, working hours, rates, required qualifications and any special arrangements.
2.3 Unless expressly agreed otherwise, the Client is responsible for the day-to-day direction and supervision of supplied workers. This does not transfer statutory duties or liabilities that remain with us.
2.4 Supplying workers does not, by itself, mean that we undertake overall event management, transport management, vehicle operation or responsibility for the Client’s business activities.
2.5 Equipment hire, managed services and other additional services are included only where expressly agreed in writing.
2.6 We will exercise reasonable care and skill in providing our services and selecting workers suitable for the requirements disclosed to us.
3. Quotations and bookings
3.1 Quotations remain valid for the period stated and are subject to availability until confirmed.
3.2 A contract is formed when you accept our quotation and these terms and we issue a Booking Confirmation. Any deposit required to secure the booking will be stated before acceptance.
3.3 We will make these terms and any applicable additional conditions available before the contract is formed.
3.4 The person booking on behalf of the Client confirms that they are authorised to bind the Client.
3.5 Individually agreed written variations take precedence over the Booking Confirmation, which takes precedence over these general terms.
3.6 Your purchase order or other standard terms do not replace these terms unless we expressly agree in writing.
3.7 Insurance documents determine the scope of insurance cover. They do not remove liabilities that exist independently of that cover.
4. Assignment information
4.1 Before we confirm a booking, you must provide accurate information reasonably necessary to assess and fulfil the assignment, including:
The Client’s identity, business activities and site contact.
The work location, start date, expected duration, hours and duties.
Required experience, training, qualifications, licences or authorisations.
Known health and safety risks and measures taken to control them.
Vehicles, machinery, equipment and specialist systems to be used.
Travel, overnight accommodation and overseas working requirements.
Relevant insurance requirements and operating restrictions.
4.2 You must inform us promptly of material changes.
4.3 Workers must not be reassigned to materially different duties, another business or a different country without our prior written agreement.
4.4 Where agency-worker legislation applies, you must provide information reasonably required for compliance, including relevant working conditions, facilities, vacancies, comparable employment terms and previous qualifying assignments.
4.5 Each party remains responsible for its own employment, payment, tax and statutory obligations.
5. Charges and payment
5.1 Rates, minimum shifts, deposits, payment deadlines and any cancellation schedule will be stated in the quotation or Booking Confirmation.
5.2 We will state whether prices include or exclude VAT. VAT will be charged where applicable.
5.3 Overtime, travel, accommodation, parking, tolls, waiting time and other expenses are chargeable only where agreed in advance or subsequently authorised by the Client.
5.4 Where delays attributable to the Client require additional time, we will notify you as soon as reasonably practicable. Additional charges will use the agreed rates.
5.5 Required induction, training and familiarisation time forms part of the assignment and is chargeable at the agreed rate unless otherwise agreed in writing.
5.6 You must raise invoice queries promptly, identifying the disputed amount and reason. Undisputed amounts remain payable by the agreed deadline.
5.7 We may claim statutory interest and recovery compensation on overdue business debts where legally available.
5.8 We may suspend future services for material non-payment after written notice and a reasonable opportunity to pay. Any suspension will be managed so far as reasonably practicable to avoid creating an unsafe situation.
6. Hours, breaks and timesheets
6.1 Working hours, minimum booking periods and overtime rates will be agreed before the assignment.
6.2 The Client must plan work to allow legally required breaks and rest and must not require workers to exceed applicable working-time or driving-hours limits.
6.3 Where timesheets are used, the Client must check them promptly and identify any disputed entries so they can be investigated.
6.4 Timesheet approval confirms the recorded hours. It does not waive a complaint about service quality.
6.5 Neither party may require a worker to falsify working-time, tachograph or other assignment records.
7. Worker suitability and replacements
7.1 We will undertake checks required of us by law and any additional checks expressly agreed in writing.
7.2 The Client must tell us promptly if a worker appears unsuitable, lacks a required qualification or cannot safely perform the agreed duties. The Client must stop any affected unsafe activity immediately.
7.3 We will investigate concerns and, where appropriate and reasonably practicable, seek a suitable replacement. A replacement cannot be guaranteed in every case.
7.4 We may substitute a suitably qualified worker where reasonably necessary. We will discuss alternatives where a particular qualification or individual is essential to the agreed booking.
7.5 Charges for disputed or unperformed services will be assessed against the booking terms and the circumstances. This clause does not remove remedies for our breach of contract.
7.6 No introduction or transfer fee is imposed by these general terms. Any such arrangement must be separately agreed in writing before it applies and must comply with applicable law.
8. Client responsibilities and site safety
8.1 The Client must provide safe access, appropriate welfare facilities and a working environment that complies with its legal obligations.
8.2 The Client must provide suitable task instructions and supervision for work under its direction and disclose relevant hazards and site rules.
8.3 Responsibility for supplying protective equipment, tools and specialist equipment must be agreed before work begins. Each party retains its own legal duties.
8.4 The Client must not instruct workers to undertake unlawful or unsafe work or tasks outside their competence or the agreed assignment.
8.5 Accidents, dangerous occurrences, safeguarding concerns and material changes to site conditions must be reported to us promptly.
8.6 We may stop or refuse work where we reasonably believe there is a serious safety risk, unlawful activity or abusive conduct. Where practicable, we will explain the issue and allow an opportunity to resolve it.
8.7 Any resulting charges must reflect a contractual entitlement and reasonable losses arising from the circumstances. We will take reasonable steps to reduce avoidable losses.
9. Induction, training and familiarisation
9.1 Before a worker begins the relevant duties, the Client must provide an appropriate site induction, task-specific instruction and any training or familiarisation necessary for the worker to perform the assignment safely.
9.2 For vehicles, trailers, machinery or equipment, familiarisation must be appropriate to the equipment and the worker’s experience. It must cover relevant controls, safety features, operating limitations, pre-use checks, defect reporting, emergency procedures and specialist equipment.
9.3 The Client must explain relevant site and traffic rules, loading and unloading arrangements, reporting requirements and emergency arrangements in a form the worker can understand.
9.4 The Client must allow sufficient time for induction and familiarisation, provide appropriate supervision and check that the worker can safely undertake the task before authorising unsupervised work.
9.5 The Client must retain appropriate records of induction, instruction and training provided.
9.6 A licence, qualification or previous experience must not be treated as proof of familiarity with a particular vehicle, item of equipment or site.
9.7 If a competence concern or need for further training is identified, the Client must stop the affected task and contact us before it resumes.
9.8 Requirements for specialist qualifications or training must be disclosed when booking, and responsibility for providing them must be agreed in writing.
9.9 These provisions do not replace our obligations to select suitable workers, undertake required checks or fulfil our own legal duties.
10. Vehicles, machinery and equipment
10.1 Where the Client provides vehicles, trailers, machinery or equipment, it must ensure that it is authorised to permit their use and that they are safe, maintained and suitable for the agreed task.
10.2 The Client must disclose known defects, supply relevant operating instructions and provide the familiarisation required by clause 9.
10.3 Vehicle and equipment condition, including existing damage, should be recorded before and after use wherever reasonably practicable.
10.4 The Client must provide clear arrangements for reporting defects and must ensure that unsafe equipment is not used.
10.5 Neither party may instruct or permit use that breaches applicable licence restrictions, load limits, driving-hours requirements or other legal restrictions.
10.6 We remain responsible for licence, competence and other checks that the law or our written agreement requires us to undertake.
11. Client motor insurance and optional driver negligence insurance
11.1 All drivers supplied by Murton Event Solutions must drive under the Client’s motor insurance. The Client is responsible for providing and maintaining cover for the vehicle, the supplied driver and the intended use throughout the assignment.
11.2 The Client’s motor insurance must satisfy applicable legal requirements in each country in which the vehicle will be used.
11.3 Before driving begins, the Client must confirm that its insurer permits the supplied driver to drive the relevant vehicle for the agreed work. The Client must disclose relevant restrictions and provide evidence of cover on reasonable request.
11.4 A driver must not be instructed to drive unless the required motor insurance is in place.
11.5 Murton Event Solutions does not provide road traffic or motor vehicle insurance for the Client. Supplying a driver does not insure the Client’s vehicle or provide comprehensive vehicle damage cover.
11.6 Optional driver negligence insurance must be requested at the time of booking. It is not automatically included in a booking or our standard charges.
11.7 Optional cover applies only where we expressly confirm its inclusion in writing before the assignment begins. A request alone does not activate cover. Any additional charge must be agreed before confirmation.
11.8 Before the optional arrangement is agreed, we will provide details of the insured party, qualifying losses, limits, excess, exclusions, territorial scope, cover period and claims conditions.
11.9 If the Booking Confirmation does not expressly confirm optional cover, the Client must not assume it applies and must contact us before work begins if the confirmation does not reflect its request.
11.10 Optional driver negligence cover is separate from the Client’s motor insurance and does not replace it. It must not be assumed to cover every third-party claim, vehicle loss, goods carried, loss of use or consequential loss.
11.11 Cover cannot be added retrospectively for an incident that has already occurred. Claims remain subject to the applicable policy terms and insurer assessment.
11.12 If optional cover is not requested and confirmed, that optional cover will not apply. Neither its absence nor an insurer’s rejection of a claim removes any separate liability arising under the contract or applicable law.
12. Operator’s licence and transport compliance
12.1 Where an assignment requires an operator’s licence, the Client must ensure that the appropriate valid licence and necessary permissions are in place throughout the assignment. If another legal entity is the licensed operator, the Client must identify it before work begins and ensure appropriate compliance arrangements are in place.
12.2 Where the Client is the licensed operator, it remains responsible for maintaining its operator’s licence and complying with its conditions, undertakings and applicable legal requirements. Engaging our drivers does not transfer its operator or transport management responsibilities to us.
12.3 The Client must maintain, or ensure that the identified operator maintains, appropriate systems for:
Vehicle and trailer maintenance, safety inspections, roadworthiness and defect rectification.
Driver entitlement and qualification checks required of the operator.
Lawful scheduling of driving, working time, breaks and rest.
Obtaining, downloading, reviewing and retaining tachograph data and other required records within applicable time limits.
Identifying, investigating, recording and addressing driver infringements, including appropriate instruction, training and follow-up.
Safe loading, load security, weight limits and operating restrictions.
Required notifications to licensing and enforcement authorities.
12.4 The Client must provide relevant procedures and the details of its transport manager or responsible contact. It must obtain sufficient information about previous work and rest to assess whether proposed duties can be performed lawfully. We will reasonably cooperate by providing relevant information available to us.
12.5 The Client must notify us promptly of alleged infringements, serious defects, prohibitions or compliance concerns involving a supplied driver and provide relevant supporting records.
12.6 We will reasonably assist with communication, investigation and appropriate action concerning the worker. This does not transfer the operator’s compliance responsibilities.
12.7 The Client must not instruct, encourage or permit unlawful driving, falsification of records or use of an unsafe vehicle. We may suspend or withdraw a driver where continuing would reasonably appear unlawful or unsafe.
12.8 The Client must notify us immediately of any suspension, revocation, curtailment or restriction affecting authority to carry out the assignment. Affected work must not proceed without lawful authority.
12.9 For overseas assignments, the Client must ensure compliance with applicable operator licensing, permits and transport requirements in the countries concerned.
12.10 Nothing in this clause removes separate statutory duties or liabilities of the Client, the licensed operator, Murton Event Solutions or the driver.
13. Road traffic offences, fines and penalties
13.1 Workers are responsible for road traffic offences they commit and fines or penalties legally imposed on them personally. We do not agree to pay or reimburse such fines merely because we supplied the worker.
13.2 If the Client receives a notice relating to an alleged offence during an assignment, it must promptly provide us with a copy, the vehicle registration, incident date and time, and relevant assignment details.
13.3 We will provide reasonable assistance in identifying the worker and passing on information, subject to applicable data protection law. This is not acceptance of liability or a guarantee that the worker will pay.
13.4 Where the applicable procedure allows driver nomination or transfer of liability, we recommend that the Client uses that procedure before paying on the worker’s behalf. The Client must follow the issuer’s instructions and provide accurate information within the required deadline.
13.5 Simply forwarding a notice to us or the worker does not constitute a valid nomination or transfer of liability.
13.6 The Client must not ignore notices or allow payment, response, nomination or appeal deadlines to expire while awaiting assistance. Where liability cannot lawfully be transferred, the person or business legally responsible must deal with the notice.
13.7 Parking charges, tolls, congestion charges, emissions charges and similar notices may follow different rules from driver-specific offences. These terms do not automatically transfer an owner’s, keeper’s or operator’s liability to a worker.
13.8 The Client must not assume that payments made on a worker’s behalf are recoverable from us.
13.9 Nothing in this clause excludes liability arising from our own breach or any liability that cannot lawfully be excluded.
14. Damage during assignments
14.1 Responsibility for damage depends on its cause, the parties’ responsibilities and applicable law. A worker’s presence when damage occurs does not, by itself, establish our liability.
14.2 We do not accept responsibility to the extent that damage is caused by the Client’s negligence, defective vehicles or equipment it supplies, inaccurate information it provides or unsafe instructions for which it is legally responsible.
14.3 This does not exclude our liability to the extent that our breach, negligence or the acts or omissions of workers for whom we are legally responsible caused or contributed to the damage.
14.4 Where workers operate under the Client’s direction, the Client is responsible for its instructions and supervision. This does not automatically transfer all responsibility for workers’ actions to the Client.
14.5 We do not provide an automatic guarantee to reimburse every instance of damage to vehicles, equipment, premises or other property. Claims will be assessed under the contract and applicable law.
14.6 Optional driver negligence insurance is governed by clause 11. Insurance availability does not determine legal responsibility for damage.
15. Incident reporting and claims
15.1 The Client must report accidents, damage and potential claims to us as soon as reasonably practicable and cooperate with applicable insurer notification requirements supplied to it.
15.2 Reports should include the booking reference, date, location, incident description, photographs, witness details and relevant supporting documents.
15.3 Both parties must take reasonable steps to prevent further loss and preserve evidence.
15.4 Except for urgent work needed for safety or to prevent further damage, the Client should allow us and any relevant insurer a reasonable opportunity to inspect damage before repairs.
15.5 Neither party may admit liability or agree a settlement on the other’s behalf without authority.
15.6 Late reporting does not automatically extinguish a legal claim, but may affect insurance cover or the assessment of a claim where evidence or recovery has been prejudiced.
16. Overseas assignments
16.1 The Client must disclose every country in which the worker will perform duties or travel as part of the assignment before booking.
16.2 Before an overseas assignment begins, the parties must agree responsibility for applicable work permissions, immigration documentation, posting notifications, social security documentation, local employment requirements, travel and accommodation.
16.3 Each party remains responsible for duties legally imposed on it. An allocation of administrative tasks does not transfer statutory responsibility.
16.4 The Client must disclose relevant local site and operational requirements and must not send workers to an unagreed country without our written agreement.
16.5 Assignments must not proceed where required permissions, documentation or insurance are missing.
17. Changes, cancellation and postponement
17.1 Requests to change, cancel or postpone bookings must be sent to info@themurtongroup.com. Cancellation takes effect when received; we will acknowledge it promptly.
17.2 Changes are subject to availability and written agreement on revised arrangements and charges.
17.3 Any cancellation schedule must be supplied and agreed before booking.
17.4 If no cancellation schedule has been agreed, cancellation charges will be limited to our reasonable net losses resulting from cancellation, taking account of costs saved and replacement work secured.
17.5 Deposits will be applied against sums properly due. Any remaining balance will be refunded.
17.6 Postponement does not automatically transfer a booking or deposit to a new date. We will explain available options and reasonable additional costs before agreeing a change.
17.7 The Client may terminate for our material breach if we fail to remedy it within a reasonable period after written notice, or immediately where the breach cannot be remedied. Cancellation charges do not apply where termination results from our material breach.
18. Suspension or termination by us
18.1 We may terminate for the Client’s material breach if it is not remedied within a reasonable period after written notice.
18.2 Immediate suspension or termination may be appropriate where continuing would be unlawful or create a serious safety risk.
18.3 If we cannot provide agreed services for reasons for which the Client is not responsible, we will notify it promptly and discuss alternatives.
18.4 The Client need not accept a materially different service. If no alternative is agreed, we will refund payments for services not provided, without removing any additional remedy available under the contract or law.
19. Events beyond reasonable control
19.1 Neither party is responsible for delay or failure to the extent caused by an event beyond its reasonable control that it could not reasonably have prevented or overcome.
19.2 The affected party must notify the other promptly and take reasonable steps to minimise disruption.
19.3 This clause does not excuse payment for services already properly supplied.
19.4 If the event prevents delivery on an essential agreed date or substantially defeats the booking’s purpose, either party may end the affected part by written notice.
19.5 Payments for services not supplied will be refunded, subject only to a separately agreed and legally enforceable allocation of unavoidable costs.
20. Liability
20.1 Nothing in these terms excludes or limits liability for:
Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Any other liability that cannot lawfully be excluded or limited.
20.2 Subject to clause 20.1, neither party is liable for losses to the extent caused by the other’s breach or negligence.
20.3 Both parties must take reasonable steps to reduce losses arising from a breach.
20.4 No general financial liability cap applies under these terms. Any additional cap or exclusion must be expressly agreed in writing before the contract is formed and must be legally enforceable.
20.5 Insurance limits do not automatically limit contractual or legal liability.
20.6 These terms do not prevent third parties from exercising rights they have independently under law.
21. Complaints
21.1 Operational concerns should be raised with our nominated contact promptly so that we have a reasonable opportunity to resolve them.
21.2 Formal complaints should be sent to [insert complaints email], identifying the booking, issue and outcome sought.
21.3 We will investigate and respond within a reasonable time, keeping the Client informed where further enquiries are necessary.
21.4 Raising a complaint does not affect either party’s legal rights.
22. Confidentiality and data protection
22.1 Each party must protect confidential information received from the other and use it only for the assignment, unless disclosure is authorised, legally required or reasonably necessary to advisers, insurers or personnel under appropriate confidentiality obligations.
22.2 This does not apply to information lawfully public or independently obtained without a duty of confidence.
22.3 We process personal information in accordance with applicable data protection law and our Privacy Notice
22.4 The Client must handle workers’ personal information lawfully and securely and disclose it only where there is a lawful basis.
22.5 Where required, the parties will agree separate data processing or sharing arrangements before the relevant processing begins.
22.6 These terms do not constitute marketing consent or replace our Privacy Notice or Cookie Notice.
23. Website use and intellectual property
23.1 Users must not misuse our website, attempt unauthorised access, introduce malicious software or interfere with its operation.
23.2 Website text, branding, photographs and other content belong to us or our licensors unless stated otherwise.
23.3 You may view the website and retain information reasonably needed to enquire about or use our services. Other commercial reuse or distribution requires permission unless permitted by law.
23.4 We take reasonable care with website content but do not guarantee uninterrupted availability. General website information does not replace an agreed specification or Booking Confirmation.
23.5 Third-party links are provided for convenience. Linking does not, by itself, mean we endorse or accept responsibility for external content.
23.6 Ownership and permitted use of materials specifically created for the Client will be agreed separately in writing.
24. General provisions
24.1 Changes to an existing booking must be agreed in writing by authorised representatives of both parties.
24.2 Website updates do not retrospectively change an existing contract.
24.3 Neither party may transfer the contract without the other’s written consent, which must not be unreasonably withheld. Use of agreed subcontractors does not remove responsibility for obligations undertaken.
24.4 If a provision is unenforceable, the remaining provisions continue so far as legally possible.
24.5 Delay in enforcing a right does not waive it.
24.6 Unless expressly stated, these terms do not give third parties a contractual right to enforce them.
24.7 Contractual notices must be sent to the contact details in the Booking Confirmation. This does not alter legal rules for serving court proceedings.
24.8 The contract documents record the parties’ agreement. Nothing excludes liability for fraud or overrides rights or representations that cannot lawfully be excluded.
25. Governing law and disputes
25.1 These terms and disputes arising from them are governed by the law of England and Wales.
25.2 The parties will first attempt to resolve disputes through good-faith discussion and may agree to mediation.
25.3 Subject to mandatory legal rules, the courts of England and Wales have exclusive jurisdiction.
25.4 This choice of law does not displace mandatory employment, transport, safety or other requirements applicable to an assignment in another country.
